Lexington authorities report that the July stabbing of a man by his brother that led to that man’s death was a “justifiable homicide.”

Lexington Police reported being dispatched to the Victorian Lakes mobile home park located at 4801 Sunset Blvd. around 3:22 a.m. on July 31 due to a disturbance, per a release. When they arrived, they found Elioquin Ponce Lopez dead in the driveway of his home, having been stabbed with a knife.

On Aug. 25, the department announced that the 11th Circuit Solicitor’s Office had reviewed the case, and that the killing was determined to have been committed in self-defense.

“Investigation and interviews of family and witnesses found that Elioquin Lopez had attacked and physically fought with several family members, including his mother,” the second release states. “Elioquin Lopez struck his mother several times with a wooden stick, which caused his brother to come to her aid. During this fight between brothers, Elioquin Lopez was stabbed in the upper body with a knife, which caused his death. The brother told detectives that he was fearful for his mother’s safety if he had not intervened. Interviews by detectives of multiple witnesses corroborated the brother’s statement.”

The release notes that the department has closed its investigation into the stabbing.

The department previously reported that several family members were involved in a physical fight leading up to the stabbing, and the brother who stabbed Lopez remained on scene and was taken in for questioning when officers arrived.

The mobile home park is located behind Carolina Medical Equipment, just down from a Hilton Garden Inn and Suites along Sunset Boulevard/U.S. Highway 378 coming into Lexington off Interstate 20.

Lexington Police noted via social media that the homicide took place in Phase 1 of the development.

This is a developing story and will continue to be updated.
